성적 자기결정권에 대하여 헌법학계 및 헌법재판소 결정은 이를 ‘성행위 여부 및 그 상대방을 결정할 권리’라고 이해한다. 이 글에서는 이러한 해석이 성적 자기결정권의 향유 및 행사의 국면에서 섹슈얼리티를 둘러싼 젠더권력관계를 간과하는 점 및 성적 자기결정권의 내용은 다양한 층위에 걸쳐 있음에도 그 내용을 성행위에 관련된 것으로만 협소하게 이해하였다는 점을 비판한다. 나아가 성적 자기결정권의 이해를 폭넓게 하기 위하여, 이 글에서는 성적 자기결정권의 인격권적 측면에 초점을 맞춘다. 성적 자기결정권은 내밀한 사적 영역에서의 행위에 머무르는 권리가 아니라, 헌법재판소가 설시한 대로 우리 「헌법」 제10조제1문의 인격의 존엄과 가치 및 행복추구권이 보장하는 인격권에서 도출되는 권리로서, 개인의 인격으로서의 섹슈얼리티 실현과 밀접한 관련을 갖는다. 이러한 관점에서 성적 자기결정권의 주체는 근대 헌법에서 상정하는 인격주의적 인간에서 더 나아가, 때로는 차이가 있고 평등하지 않은 사회적 관계 속에서 동등한 구체적인 개인으로 상정된다. 성적 자기결정권의 내용도 성행위로서의 성뿐만 아니라 성적 지향, 성별 정체성을 토대로 한 성(sexuality)의 실천을 위한 다양한 층위의 다양한 행위를 포함한다. 그리고 차이를 갖는 동등한 개인이 각자의 성적 자기결정권을 행사함에 있어 타인을 성적 대상화하지 않고 그의 타인의 성적 자기결정권을 인정하며, 이를 존중하면서 자신의 권리를 행사하여야 한다. 인간의 성적 행동은 단순한 생물적･신체적 활동이 아니라 인간의 내면에 뿌리를 둔 그 인격과도 깊이 관련되는 정신적 활동이기 때문에, 성적 자기결정권은 통합성을 갖는 권리라고 하겠다.
The Constitutional Court of Korea interprets the right to sexual self-determination as the freedom to choose sexual activities(focusing on sexual intercourse) and partners. This article criticizes the above perspective as follows; overlooking gendered contexts over sexuality, narrowly understanding it only as related to sexual activities. Based on this criticism, this article focuses on the ‘personal right’ aspects of sexual self-determination. Sexual self-determination is closely related to the realization of sexuality as an individual's personal right under Article 10 of the Korean Constitution which promotes the right to personality and right to pursue happiness. The subject of sexual self-determination goes further than the individual human beings envisaged in the modern constitution, and is assumed to be equivalent, concrete individuals in differing and unequal social relations. The contents of sexual self-determination include not only sexual activities but also various practices of sexuality based on sexual orientation and gender identity. And the individual shall exercise his or her rights by acknowledging and respecting the other person's rights to sexual self-determination.
